CONTRACT.
By signing this contract you are agreeing to:
All specifications will be agreed within the information provided within your quote and project confirmation document. Any deviations to these agreed specifications may incur further charges.
A standard non refundable deposit is required before a clients work can be booked or started. Delay in payment, will result in delay of work taking place and may result in a change of time schedule or loss of development time quoted.
I aim to work with my clients to complete projects within the time frame outlined in the confirmation document. I also expect clients to work to this time frame with the same commitment, understanding that projects not completed on time incur financial detriment within my business. Project delays that are as a result of clients not meeting the proposed time frames provided may incur further charges to be made.
I reserve the right to cancel a commission at any time, in result to perceived harassment, intimidating communications or threats from client or associates, with the clients deposit to be non refundable on this basis.
Details regarding changes to the project are preferred via email communication for reference of both parties. Where details have been communicated via other methods a follow up email containing the information discussed will be required.
The client enters into this contract based on previous work or recommendations of knowledge of my work, and may not, once entered into agreement with deposit paid, be refunded the deposit if wishing to leave the agreed contract. Once the client has paid the initial deposit, the deposit is non refundable except for reason mentioned in section 11.
I reserve the right to refuse ideas from the client, if the ideas do not comply with my brand or ethos.
Any breach of the contract may result in termination the contract without warning and without refund of deposit paid.
If work has begun on the project and the client changes their mind on the completion date or delays completion the remaining balance of the site is still due on the agreed completion date, unless otherwise agreed.
If the client ceases to continue with the project either before the project has started or once the project has started the deposit is non-refundable due to commitment of time available to book alternative work being lost and loss of time in work already committed to. If the client ceases to continue with the project once work has begun, the client is also liable to pay a percentage of the final balance depending on the time and amount of work completed so far. Once this percentage has been paid all works to their current unfinished state will be transferred to the client.
The client may be eligible for the deposit to be refunded if I cannot complete the client’s work within the agreed time period by my own admission of fault or damaged or incapable equipment resulting in completion of work to not be obtainable within the discussed time period. Other situations will be considered, but not guaranteed.
Correspondence received from clients, will usually be replied to within 48 hours.
On completion of the clients project, any work will be transferred as outlined and first agreed. Either digitally downloadable via Gdrive, or online through password protected log in systems. Once file transfer/ownership transfer is complete, files and websites are the responsibility of the client and the client is recommended to back up their files/websites for future use and work. I will keep on file any work for the client for 6 months. After this time files will either be archived or deleted.
I will not be held accountable for the clients experience or commitments regarding file/website transfer and platform management, once projects have left my possession. I will not be held accountable for issues and required updates arising with third party systems and apps that have been integrated with the websites I have created.
The deposit is required once initial contact and design intention have been agreed by both myself and the client, before any work can commence. Charges resulting from changes to the agreed initial contract are required to be paid before final files/website and ownerships are transferred to the client. Final concluding payment of the remaining balance of the initial agreed cost is payable once final work is agreed and as outlined on the payment terms within the clients confirmation document.
I accept no responsibility for any business failure, loss of business or detrimental activity to the business linked to any design work, activity undertaken on behalf of the client, or infrastructure failure such as website downtime and apps failing to work. Once files/websites have been completed and handed over to the client all responsibilities of systems and files are the clients.
The agreed price in the clients confirmation document may change if additional services are required by the client outside of the initial brief. This includes any extra requests once the project has started, including additional functionality to the site that requires a further time frame of work that has not been discussed before the initial quote was drawn up.
Once handover has been completed, support with clients websites will be required to be booked into an available time slot. If clients requests are emergency requests, I will always do my best to support with this as quickly as possible. However, I do ask for patience and understanding that this is sometimes not possible on the same day.
For additional general amendments, fixes and support, once client projects have been handed over, there is a flat rate charge of £50 + £50 per additional hour required to work on the amendments. This includes emergency support. For larger amendments and functionality changes within clients websites, these projects will be quoted for individually. All costs will be pre-quoted for the clients approval before any work commences.
